      CREATING AN ACCOUNT AND PURCHISING RULES

      These are some important requirements. Your account must be made with your legal name, no aliases. Accounts and orders cannot have two names. The account owner and purchaser/buyer must be the same person. If you want to buy someone a firearm or non-firearm item, you can buy a major credit card company gift card for them to use on their own account. Please DO NOT enter your FFL’s address on your account (unless you are the FFL dealer creating an account), enter your billing address and shipping address only (shipping and billing must be the same unless approved by SAO Guns).

      ONLINE PRICE AND DESCRIPTION ERRORS

      You are advised to verify the SKU, model number, and UPC are correct for the items you are ordering prior to completing checkout. Items may appear on the website by mistake, or the item’s description may contain a typographical error. We do not guarantee that titles, descriptions, pictures, or prices on our site are 100 percent accurate and/or correct. Out of Stock pricing will not always be accurate, we do not always know the cost or price of that item until we get it back in stock, it can vary from item to item. Prices change from the manufacturer and the distributor, and those prices are adjusted once the item is in stock. Pictures (images of items) are not always accurate and may not represent the actual item or may only be a similar representation. An example is some pictures/images include an optic/scope and/or accessories, and the item does not come with an optic/scope and/or accessories. Manufacturers change the contents of packaging, which may not get updated on our website. It is always best to confirm with the manufacturer the most accurate description, contents, features, and images of the product and verify the UPC (Universal Product Code) is correct for the product you want to purchase. A lot of our descriptions, what’s included, features, and images are pulled from our distributor feeds and may not fully represent the item or could be unintentionally be incorrect. We will not accept returns, offer discounts or refunds due to these inaccuracies. There are tens of thousands of items being fed/transmitted to our website, and we do our best to check them but it is impossible for us to verify that everything advertised about the item is correct. We would never intentionally misrepresent a product, but we make no guarantees about these accuracies. We reserve the right to refuse or cancel any order including but not limited to orders for items with errors in the description or price. If we cancel an order, we will immediately issue a refund to the same payment method used on the order.

      CREDIT/DEBIT CARD AUTHORIZATIONS

      You must use your credit/debit card billing address on file with your card company for the billing address when you check out. If your billing address and zip code do not match what your card company has on file, your order will be declined, although your card company may approve the amount of the charge. This can create a situation where the amount of the charge is held by your card company for a period of time. Your card company, not us, controls the hold and release times and we can do nothing to speed up the release. We do not collect the funds unless the order is approved on our end and you get an email confirmation from us (provided you entered your email address correctly).

      GENERAL FIREARM SALES

      All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering.

      All new firearms are shipped in the original manufacturer’s box, with magazine(s), accessories and applicable warranty. Firearms sales are final. Firearms requiring warranty work must be returned to the factory within 1 year or that manufacturer’s warranty timeframe of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all products.

      PURCHASING FIREARMS ONLINE

      The person purchasing the firearm through our website must be the person who picks up the firearm. We do not allow someone to buy a firearm online as a gift for someone else. Our merchant processor is very strict that the name on the credit card must be the buyer and the person the firearm is transferred to. It is illegal to ship firearms to anyone who does not hold an active Federal Firearms License (FFL). For that reason, firearms purchased online may be picked up at our store or shipped to an FFL (gun store) near you. We may contact and verify the FFL you select during checkout before shipping your firearm(s). The buyer is encouraged to contact the receiving FFL licensee before purchase. It is your responsibility as a customer to know whether you can legally possess the firearm you purchase in the state in which you live or if it is restricted in any way. If you are unsure, you will need to contact your FFL dealer and verify that the firearm is legal in your state or not restricted. Please see our policy on returns below for firearms shipped by mistake as this will apply to a firearm you order that is not legal to possess in your state or restricted in your state, or in cases where you are not familiar with the laws and are not able to (or choose not to) keep the firearm. We do not substitute magazines or accessories. It is your responsibility to check and/or know the laws of your state.

      SHIPPING INSURANCE

      When placing an order for delivery to you or your FFL dealer for firearms, you have a choice to choose Standard Shipping with no insurance or Insured Shipping with insurance. If you choose to have your product shipped without insurance, you will be responsible for products that are lost, stolen, misdelivered, or damaged. SAO will not be liable. You will not receieve a replacement or be reimbursed or refunded.

      IMPORTANT NOTICE:

      By placing an online order with us and using your credit card to purchase a firearm that has to be shipped to an FFL dealer by law, you agree that should you fail to retrieve the firearm from the FFL dealer it was shipped to, you will NOT dispute the charge and claim that you did not receive the firearm. You also agree that should you fail to pick up that firearm, you will notify us by certified mail or by email to us with an acknowledgment from us that we have received your email that you were not able to pick up the firearm from the FFL dealer and advising us of the reason. You agree to pay for the shipping charges that you paid to ship the firearm to your FFL dealer, and any return shipping charges, in addition to a 15% restocking fee.

      CHANGING, MODIFYING, SUBSTITUTING ORDERS

      We like to serve customers best as possible and we understand that mistakes can happen. If you have placed an existing order and want to change it, we can help you with that. The process is as follows: orders that need modified will be cancelled and the customer will be refunded the full amount via gift card for use on our website. Once the customer receives the refund they can replace the order on the website. SAO will not place the order for the customer due to fraud and sensitive information that gets exchanged in transactions. At this point the transaction lead times have restarted.

      RETURNS & CANCELED ORDERS

      Because of our very low pricing structure and profit margins, all sales are final in most cases, although manufacturer warranties will apply. If you have any type of issue with your product, the fastest resolution is to contact the manufacturer, and you must agree to this before placing the order, and by placing your order you are agreeing with our Store Policies also known as Terms. To maintain our low prices, we ask the customer to deal directly with the manufacturer, as this will always result in the fastest resolution. If you have issues with the manufacturer, we will be happy to get involved and help as much as possible. If you have simply changed your mind on what you purchased, or if you are denied by the ATF or the FFL dealer refused to sell you the firearm, or you ordered the firearm by mistake, we can review your request for a return; but you will lose any shipping charges you paid, and you will have to pay return shipping as well plus there will be a 15% restocking fee. If your item is returned to us as undeliverable or refused by the FFL dealer, you will be responsible for the return shipping charges and shipping charges back to another FFL dealer if you choose to have the item reshipped. If you prefer a refund after it has been sent back to us, we will deduct the original shipping charges to ship it to your dealer, the return shipping charges to ship it back to us, and the 15% (25% for SOT/NFA items) restocking fee from your refund. Never ship a product back to us without approval. All returns must be approved and may not necessarily be sent back to us; the item may need to be returned to the distributor if initially shipped from the distributor.

      THERE ARE NO EXCEPTIONS TO NO RETURNS AND NO CANCELLATIONS ON THE ITEMS LISTED BELOW:

      Special orders including items not in local inventory (distributor orders).

      SOT/NFA orders that have been processed (Form 3 submitted for transfer to SAO or your FFL dealer).

      Products sold “as is” or “used” or that have been installed or used after receipt.

      Knives, ammo, illumination devices, electronic sights, and optics

      Firearms that have been transferred to you on a 4473 via an FFL dealer.

      To clarify, a return is not the same as a cancellation. A cancellation is made prior to the order being submitted to our distributor for shipping or prior to us processing and/or shipping the item. Just because we have not shipped your order does not always mean it can be canceled. Not all orders can be canceled, however, on any order that is canceled, there is a $15 cancellation fee. You will never be charged a cancellation fee for an order that is canceled because the item you ordered is out of stock. A cancellation may be because you ordered the wrong item, decided you no longer want the item you ordered, decided you want a different model, you failed to provide an FFL dealer we can ship to, or for other reasons not specified here. We charge a cancellation fee because it costs us money to process an order and then cancel it, and our merchant provider (card services company) charges a fee for refunds.

      USED FIREARMS

      Used firearms may not be returned. All sales are final. Descriptions and photos are provided if available. However, we rarely sell used firearms from our local store. From time to time, our distributors may offer used items fed to our website through their distributor feeds. We have no visible knowledge of the condition of these items, and we will not be responsible for the condition of these items in any way whatsoever. Our distributors will not take the time to go and look at these items in their warehouse to advise of the condition, and in some cases, their condition description may be subjective at best. You are entirely on your own in taking a chance at purchasing these items. We are letting you know in advance that buying a used gun from anyone is a risk.

      AMMUNITION PURCHASES

      You must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required and sales on these items are final. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations. Customers are responsible and must follow all local, state and federal laws. Please research before ordering if you are unsure about your local laws.

      ORDER FULLFILMENT

      All orders are shipped promptly from a distributor warehouse or in-store inventory within 1 – 10 business days (depending on time and day the order is placed and processed) using UPS, FedEx, or USPS. Tracking numbers are available for items shipped via UPS and FedEx. Our shipping rates and shipping policy only qualifies for the lower 48 states. We currently do not offer shipping outside the United States or international. If an order is placed outside of the stated perimeters, it will be cancelled and a refund will be issued. Orders cannot be processed and will be flagged as fraud if the billing and shipping address do not match. If an order is for a serialized item or firearm the system will dictate it as such and it will be sent to the chosen FFL. Again, please do not put the FFL as the shipping address.

      SHIPPING

      All packages are shipped with signature required and this option cannot be waived. We ship to the CONUS (Continental United States) at published rates when shipping from our store. This includes the 48 contiguous states and excludes Alaska, Hawaii, Puerto Rico, and the other U.S. territories. Shipping to Alaska and Hawaii may be available but there may also be additional shipping charges… published rates may not apply. If it requires customs forms, we will not ship. Drop shipments from our distribution warehouses should be standard shipping rates calculated at checkout. Our handgun/pistol shipping rates are based on shipping via USPS in most cases. If your FFL dealer cannot accept USPS, UPS, or FedEx shipments, the shipping rate may not be the same as published, and you will be responsible for additional shipping charges unless you choose another FFL dealer. Please contact us for additional shipping charges using the EMAIL US link at the top of the page or at info@saoguns.com. Not all items are available for shipping. If an item only shows “in-store pickup” available at checkout and will not allow you to choose a shipping method, this means it is not shippable and must be picked up in our store.

      Heavy Items Shipping: Some heavy items, such as gun safes and other items that way over 30 pounds, will require extra shipping that cannot be calculated with the order. The shipping charges on the order will be incorrect. In this case, after your order is placed, we will contact you with the additional shipping charges and a link to pay for these charges. You are not obliged to these items, and if the shipping is more than you would like to pay, we will cancel the order for you and issue a full refund.

      If your FFL dealer uses their mailing address instead of their premises address for shipping, we must be notified in advance, before you place the order, to make sure we have their mailing address entered in our system as their shipping address. If your dealer does not accept delivery from a particular carrier/shipper, we must be notified in advance on each order. Failure to do this may result in your package being returned, and you will incur additional shipping charges. We cannot use an address if it is not listed on their FFL. If you place the order and then notify us of changes in shipping, you risk the item being shipped before we see the email… or you risk us not seeing the email because it does not reach us for some reason. You are better off not choosing an FFL dealer if you can’t wait to order for fear of losing out on an item. In this case, we will request your FFL dealer info, and you can advise us at that time of any changes or updates to the FFL or shipping preferences. Under no circumstances can a firearm be shipped to an address not listed on the dealer’s FFL.

      SECURE TRANSMISSION

      All information collected during the checkout process is transmitted via industry-standard Transport Layer Security (TLS). A Transport Layer Security (TLS) Certificate (or SSL Certificate) creates an encrypted connection between a Web site and a visitor’s Web browser. This link ensures that all data passed between the Web site and the browser remains private and secure.

      CONDITIONS OF USE

      Use of the SAO website constitutes agreement to our terms of use. We encourage you to review the following information carefully.

      AFFIDAVIT OF CUSTOMER

      • I am not an unlawful user or addicted to any controlled substance.
      • By selling or delivering ammunition to me, SAO is not violating any state or local law or ordinance.
      • I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
      • I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
      • I am not a fugitive from justice.
      • I am currently not subject to a restraining order of any kind.
      • I have not been adjudicated as a mental defective and I have not been committed to any mental institution.
      • I am not an illegal or unlawful alien.
      • I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.
      • I am not currently less than twenty-one (21) years old.
      • I have not renounced my U.S. citizenship.

      INDEMNIFICATION AND AGREEMENT TO DEFEND

      I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release .com and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from SAO.

      I fully agree that by placing my order, I release SAO from any and all liability arising from or related to the products I purchased from SAO, including (but not limited to) my or anyone else use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release SAO and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from SAO.

      CLASS ACTION WAIVER

      You expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action.
